The purpose of these General Terms and Conditions of Sale (the " GTCS ") is to provide a legal framework for the provision of services, as well as the website and associated mobile applications, by SEALOCKER, a simplified joint stock company, and to define the conditions of access to and use of the services by " The Customer " and " The Supplier " responsible for providing the service.
SeaLocker offers a platform for establishing contact between the Customer and the partner Supplier. These GTC also govern the terms and conditions for presenting the services and products made available by the Supplier to the Customer via the SeaLocker platform.
SeaLocker may act as Supplier by making products available and providing services under certain specific conditions (when SeaLocker is the owner of the products). In this case only, SeaLocker will assume the role of Supplier and the associated responsibilities.
These T&Cs are accessible and approved (via a checkbox) by the Customer and the Supplier upon registration (on their respective application) and each time they attempt to connect to the mobile application.
Any registration or use of the site and mobile applications implies unreserved and unrestricted acceptance of these GTC by the Customer and the Supplier. When registering on the application, each Customer and Supplier expressly accepts these GTC by checking the box preceding the following text: "By checking this box, I declare that I am 18 years of age or older and that I accept SeaLocker's Terms of Sale and Privacy Policy".
In the event of non-acceptance of the GCS stipulated in the present contract, the Customer and the Supplier must renounce access to the services offered by SeaLocker. SeaLocker reserves the right to unilaterally modify the content of these GTC at any time.
Article 1: LEGAL NOTICE
The Sealocker website, online services and mobile applications are edited and published by Mr. Nicolas Farolfi. E-mail address nicolas.farolfi@sealocker.fr.
Theoperator is designated as the simplified joint stock company represented by MONSIEUR NICOLAS FAROLFI, as President.
Theoperator assumes full responsibility due to the present Terms and Conditions.

Article 2 - GENERAL PROVISIONS RELATING TO THESE GENERAL TERMS AND CONDITIONS
The general terms and conditions of sale (the " General Terms and Conditions of Sale ", or the " GTS") apply exclusively to the online sale of services provided by the Supplier, and offered by the Operator on the SeaLocker and SeaLocker Partners Website and mobile applications.
The GCS are made available to the Customer and the Supplier on the Website and on the mobile applications, where they can be consulted directly and can also be communicated to the Customer on request by any means.
The GCS are binding on the Customer and Supplier, who acknowledge that they have read and accepted them before placing an order or making a product/service available on the platform, by checking a box provided for this purpose. Validation of the order by its confirmation implies acceptance by the customer and the supplier of the GCS in force on the day of the order, which are kept and reproduced by the Operator.
The General Terms and Conditions are also systematically sent with any order confirmation sent to the Customer and Supplier by the Operator. All Customers and Suppliers are therefore deemed to have read and accepted without reservation all the provisions of the GTS, which will apply to all services provided by the Operator and its Suppliers. The GTS shall prevail over any clauses and conditions to the contrary that may appear in the general terms and conditions of purchase or any other document issued by the Customer or the Supplier. In the absence of express acceptance by the Operator, any conditions set by the Customer or Supplier to the contrary shall be unenforceable against the Operator. However, the Operator reserves the right to deviate from certain clauses of the GCS, depending on the negotiations conducted with the Customer or Supplier, by establishing special conditions of sale (in particular by concluding a service or rental contract) which will be approved by the Customer or Supplier.
The Operator works to connect Customers and Suppliers through its platform (Website and mobile application) for the delivery of products and associated services. The Operator disclaims all responsibility for the provision of services and products supplied by the Supplier to the Customer. The Operator cannot be held responsible in the event that an order cannot be fulfilled due to lack of availability on the part of the Supplier.
SeaLocker may act as Supplier by making products available and delivering products under certain conditions (when SeaLocker is the owner of the products). In this case only, SeaLocker will assume the role of Supplier and associated responsibilities.
Article 3: DESCRIPTION OF SERVICES
The SeaLocker website and mobile applications provide the Customer with paid access to the following services (hereinafter the " Services "):
- Rental and sale of sports equipment: surfboards, made available by SeaLocker's partner suppliers.
And to the Supplier free access to the following services (hereinafter the "Services"):
- Provision and management of the stock of boards for rental and sale for Partner Suppliers.
The website and mobile applications are accessible free of charge from any location to any Customer and Supplier with Internet access. All costs incurred by the Customer and Supplier to access the services (hardware, software, Internet connection, etc.) are at their own expense.
The Customer and Supplier remain responsible for the terms and consequences of their respective access to the Site and mobile applications, in particular via the Internet. Such access may involve the payment of fees to technical service providers such as Internet access providers, which remain at their charge. In addition, the Customer and Supplier shall provide and be fully responsible for the equipment necessary to connect to the Site and mobile applications.
The Customer and the Supplier acknowledge that they have verified that the computer configuration they use is secure and in working order.
The Services presented on the Site and mobile applications are each described in terms of their essential characteristics. The photographs illustrating the Services do not constitute a contractual document. The Services comply with the provisions of current French law.
Non-member customers and suppliers do not have access to the reserved services. To do so, they must register by completing the form. By agreeing to register for the reserved services, the customer and supplier members undertake to provide truthful and accurate information concerning their civil status and contact details, in particular their e-mail address and mobile telephone number.
To access the services, the customer and supplier must then identify themselves (email / password or cell phone number). Any Customer or Supplier who is a regularly registered member may also request to be deregistered by sending an explicit request to the email address nicolas.farolfi@sealocker.fr
SeaLocker cannot be held responsible for any event due to force majeure which results in a malfunction of the site or server, subject to any interruption or modification in the event of maintenance.
In such cases, the Customer and the Supplier hereby agree not to hold the publisher responsible for any interruption or suspension of service, even without prior notice.
The Customer and the Supplier may contact the site by e-mail at the publisher's e-mail address given in ARTICLE 1.
Article 4: CREATION OF MEMBER SPACE
To place an order on the Site or the mobile application, the Customer and the Supplier must first create their personal space. Once created, to access it, the Customer must identify himself using his personal telephone number and validate with a code received by SMS. The Supplier must enter his email address and password. It is the Customer's and Supplier's responsibility not to communicate their telephone number, login, email or password, which could corrupt the integrity of their access to the services; in accordance with the provisions of article PERSONAL DATA herein.
Each Customer and Supplier undertakes to maintain strict confidentiality with regard to data, in particular telephone numbers, access codes, etc., enabling them to access their member area. The Customer and Supplier acknowledge that they are solely responsible for accessing the Service by means of their telephone number and e-mail address/password respectively, unless fraud has been proven. Each Customer and Supplier further undertakes to inform the Operator without delay in the event of loss, misappropriation or fraudulent use of access identifiers.
When registering, the Customer and Supplier undertake to :
- provide true, accurate and up-to-date information at the time it is entered in the service registration form, and in particular not to use false names or addresses, or unauthorized names or addresses.
- to keep registration data up to date in order to ensure that it is real, accurate and up-to-date at all times.
The Customer and the Supplier further undertake not to make available or distribute any illicit or reprehensible information (such as defamatory information or information constituting identity theft) or harmful information (such as viruses). Should this not be the case, the Operator may suspend or terminate the Customer's or Supplier's access to the Site or mobile applications, at its sole discretion.
Article 5 - USE OF SERVICES BY SUPPLIER AND PUBLICATIONS
The site allows Supplier members to publish the following content:
- Advertisements for the rental and sale of their products (surfboards).
In their publications, members undertake to respect the rules of Netiquette (rules of good conduct on the Internet) and the applicable laws. The Operator may exercise moderation over publications and reserves the right to refuse their publication online, without having to justify this to the member.
The member remains the owner of all intellectual property rights. However, by publishing a publication on the site, he/she grants the publishing company the non-exclusive and free right to represent, reproduce, adapt, modify, broadcast and distribute his/her publication, directly or through an authorized third party, throughout the world, on any medium (digital or physical), for the duration of the intellectual property.
In particular, the member grants the right to use his or her publication on the Internet and cell phone networks.
Any content placed online by the Supplier member is his sole responsibility. The Supplier member undertakes not to put any content online that could harm the interests of third parties. Any legal action taken by an injured third party against the site shall be borne by the Supplier.
The Supplier member's content may be removed or modified by the site at any time and for any reason, without prior notice.
Article 6 : COMMANDES / RESERVATIONS
Au moment de passer une commande (effectuer une réservation), le Client doit sélectionner les Services choisis, et approuver. Le Client a la possibilité de vérifier le détail de la commande et son prix total, et de revenir aux pages précédentes pour éventuellement corriger la description du Service et du produit réservé, avant de le valider.
Le Client s’engage à lire les Conditions Générales alors en vigueur avant de les accepter et de confirmer les modalités et les éventuels frais de livraison et de rétractation préalable au paiement de sa commande. La confirmation de la commande entraîne l'acceptation des CGV et forme le contrat.
L'attention du Client est particulièrement attirée sur le mode d'acceptation de la commande passée sur le Site et l’application mobile. Lorsque le Client passe sa commande il doit confirmer celle-ci par la technique du « double-clic », c'est-à-dire qu'après avoir sélectionné des Produits et vérifié les détails du service (dates de location, conditions et garanties, assurance...), le Client doit contrôler et éventuellement corriger le contenu de sa réservation (identification, dates sélectionnées, assurance, prix, modalités et frais de livraison, garanties) avant de la valider et de renseigner ses coordonnées bancaires.
Ensuite, il valide sa commande après avoir rempli ses coordonnées bancaires. Enfin, en cliquant sur « j’approuve ». Il reconnaît accepter les présentes CGV avant d’approuver. Le « double clic » vaut signature électronique et équivaut à une signature manuscrite. Il constitue une acceptation irrévocable et sans réserve de la commande par le Client.
Pour le cas des locations, un contrat de location adapté aux termes et conditions du service validé par le Client lui sera proposé, et sera approuvé de la même manière par ce-dernier par la méthode du « double clic ». Ce contrat de location vient en complément des présentes CGV sans les remplacer. Il précise les conditions supplémentaires et éventuelles garanties dont dispose le Client dans le cas de la location du matériel auprès du fournisseur.
L'archivage des communications, des bons de commande et des factures est assuré par l’Exploitant sur un support fiable et durable de manière à constituer une copie fidèle et durable. Ces communications, bons de commande et factures peuvent être produits à titre de preuve du contrat. Sauf preuve contraire, les données enregistrées par l’Exploitant sur Internet ou par téléphone constituent la preuve de l'ensemble des transactions passées entre l’Exploitant et ses Clients.
Une copie des présentes Conditions Générales telles qu’acceptées par le Client et le Fournisseur, sera envoyée aux deux parties par e-mail au moment de la confirmation de la Commande client, afin que ce dernier puisse s’y reporter.
Les informations contractuelles relatives aux réservations (dont notamment le n° de la réservation) feront l'objet d'une confirmation par voie d'e-mail en temps utile. L’Exploitant conseille vivement au Client d'imprimer et/ou d'archiver sur un support fiable et durable cette confirmation de commande à titre de preuve.
Une facture numérique peut être réclamée par le Client si la demande est expressément effectuée par email à l’adresse nicolas.farolfi@sealocker.fr. Le détail des réservations du Client est disponible dans l’onglet « Mes réservations » de son application mobile.
Tout email qui sera adressé au Client et au Fournisseur dans le cadre d’une commande le sera à l’adresse email qu’ils auront renseigné dans leur informations personnelles ou par SMS, sur le numéro de téléphone utilisé pour l’accès aux services. Il incombe au Client et au Fournisseur la validité des informations renseignées pour la bonne réception des documents.
L’Exploitant se réserve le droit de ne pas valider la commande du Client pour tout motif légitime, notamment dans l’hypothèse où :
- Le Client ne respecterait pas les Conditions Générales en vigueur lors de sa commande ;
- L’historique de commandes du Client montre que des sommes restant dues au titre de précédentes commandes ;
- L’une des précédentes commandes du Client fait l’objet d’un litige en cours de traitement ;
- Le Client n’a pas répondu à une demande de confirmation de sa commande que l’Exploitant lui a fait parvenir.
L’Exploitant archive les contrats de location et factures de Services conformément à la législation applicable. En formulant une demande à l’adresse suivante nicolas.farolfi@sealocker.fr, l’Exploitant remettra au Client une copie du document objet de la demande.
Toute modification de commande par le Client après confirmation de sa commande est soumise à l'accord de l’Exploitant. Les informations communiquées par le Client lors de la passation de la commande engagent celui-ci. Ainsi, la responsabilité de l’Exploitant ne saurait en aucune manière être recherchée dans l'éventualité où une erreur lors de la passation de la commande empêcherait ou retarderait la livraison/la délivrance.
Le Client et le Fournisseur déclarent avoir la pleine capacité juridique leur permettant de s'engager au titre des présentes Conditions Générales.
L'inscription est ouverte aux majeurs capables et aux mineurs à condition que ceux-ci interviennent sous la surveillance du parent ou tuteur détenant l'autorité parentale. En aucun cas, l'inscription n'est autorisée pour le compte de tiers à moins d'être valablement habilité à le représenter (personne morale par exemple). L'inscription est strictement personnelle à chaque Client et à chaque Fournisseur.
En cas de manquement par le Client ou le Fournisseur à l'une des dispositions des présentes, l’Exploitant se réserve le droit de résilier sans préavis le compte dudit Client ou Fournisseur.
Article 7 - PAYMENT TERMS AND SECURITY
The Customer expressly acknowledges that any order placed on the Site and the application is an order subject to payment, which requires the payment of a price in exchange for the provision of the Service ordered.
The Customer is hereby informed that the Service will not be made available until the Operator has received full payment of the sums owed by the Customer.
The Operator uses the STRIPE online payment solution (https://stripe.com/). Orders may be paid for using one of the following payment methods:
- Payment by credit card. Payment is made directly to the secure bank servers of the Operator's bank, the Customer's bank details do not pass through the Site or mobile application. Details of payment identifiers are stored on the servers of our approved and secure payment provider STRIPE.
These are kept to facilitate payment. They may be permanently deleted if the customer expressly complains to nicolas.farolfi@sealocker.fr.
Bank details communicated at the time of payment are protected by an SSL (Secure Socket Layer) encryption process. These details are therefore not accessible to third parties.
The Customer's order is registered and validated as soon as the bank accepts the payment.
The Customer's account will only be debited for the corresponding amount once (i) the credit card details have been verified and (ii) the debit has been accepted by the bank that issued the credit card.
Failure to debit the sums due will result in the immediate invalidation of the order. In particular, the credit card may be refused if it has expired, if it has reached the maximum spending amount to which the Customer is entitled, or if the data entered is incorrect.
In such cases, the order validated by the Customer will not be considered effective until the secure bank payment center has given its approval of the transaction.
As part of the control procedures, the Operator may have to ask the Customer for any documents required to finalize the order. These documents will not be used for any other purpose.
Article 8 - PAYMENT OF THE PRICE
The price of the Services in force at the time of the order is indicated in euros including all taxes (TTC) on the Site and mobile application. In the event of a promotion, the Operator undertakes to apply the promotional price to all orders placed during the promotional advertising period.
The price is payable in euros (€) only.
The price is payable in full once the order has been confirmed. The prices quoted include any discounts and rebates that the Operator may grant.
The total amount due by the customer and the details are shown on the order confirmation page.
Article 9 - DROIT DE RETRACTATION, D’ANNULATION ET DE REMBOURSEMENT
Le Client bénéficiera d’un délai de rétractation de quatorze (14) jours calendaires à compter de la conclusion du contrat, conformément à l’article L. 221-19 du Code de la consommation.
Pour éviter tout abus, et éviter de compromettre le bon fonctionnement du service, le client ne pourra ni exercer son droit de rétractation, ni demander une quelconque demande de remboursement dans les 24 heures qui précèdent le début de la prestation de service, ainsi que les 4 premières heures qui suivent.
Toute demande spécifique qui viendrait transgresser ces conditions, devra être émise à l'adresse email de l'Exploitant: nicolas.farolfi@sealocker.fr, et sera étudiée par celui-ci. La demande pourra être acceptée au cas par cas, sous certaines conditions spécifiques.
Si le Client désire exercer son droit de rétractation, il devra assumer les frais relatifs aux commissions des fournisseurs de paiement, frais de dossier et taxes appliquées lors de la commande, avant remboursement.
Si le Client souhaite que l'exécution d'une prestation de services commence avant la fin du délai de rétractation, l’Exploitant recueille sa demande expresse par tout moyen.
Le Client qui a exercé son droit de rétractation pour une prestation dont l'exécution a commencé, à sa demande expresse, avant la fin du délai de rétractation, verse à l’Exploitant un montant correspondant au service fourni jusqu'à la communication de sa décision de se rétracter ; ce montant est proportionné au prix total de la prestation convenu dans le contrat (et sera donc égal au prix total de la prestation si l’intégralité de la prestation a été effectuée).
Conformément à l’article L.221-21 du Code de la consommation et afin de mettre en œuvre ce droit de rétractation dans les conditions des articles L. 221-18 et suivants du Code de la consommation, le Client est invité à remplir le formulaire type de rétractation en cliquant sur le lien ci-après :

L’Exploitant adressera un accusé de réception de la demande de rétractation du Client par e-mail. Le cas échéant, le Client peut exercer son droit de rétractation en notifiant les informations suivantes à l’Exploitant :
- nom, adresse géographique, numéro de téléphone et adresse électronique ;
- décision de rétractation au moyen d'une déclaration dénuée d'ambiguïté (par exemple, lettre envoyée par la poste, télécopie ou courrier électronique dès lors que ces coordonnées sont disponibles et de ce fait apparaissent sur le formulaire type rétractation). Le Client peut utiliser le modèle de formulaire de rétractation mais ce n'est pas obligatoire.
Les exceptions de l’article L.221-28 du Code de la Consommation s’appliquent et font obstacle à l’exercice du droit de rétractation, notamment si la commande consiste en un contrat (notamment) :
1° De fourniture de services pleinement exécutés avant la fin du délai de rétractation et dont l'exécution a commencé après accord préalable exprès du consommateur et renoncement exprès à son droit de rétractation ;
2° De fourniture de biens ou de services dont le prix dépend de fluctuations sur le marché financier échappant au contrôle du professionnel et susceptibles de se produire pendant le délai de rétractation ;
8° De travaux d'entretien ou de réparation à réaliser en urgence au domicile du consommateur et expressément sollicités par lui, dans la limite des pièces de rechange et travaux strictement nécessaires pour répondre à l'urgence ;
11° Conclu lors d'une enchère publique ;
12° De prestation de services d'hébergement, autres que d'hébergement résidentiel, de services de transport de biens, de locations de voitures, de restauration ou d'activités de loisirs qui doivent être fournis à une date ou à une période déterminée ;
13° De fourniture d'un contenu numérique non fourni sur un support matériel dont l'exécution a commencé après accord préalable exprès du consommateur et renoncement exprès à son droit de rétractation.
L’Exploitant remboursera au Client les sommes dues décomptées des frais liés aux commissions fournisseurs, des services de paiement STRIPE, des frais de dossier et des taxes associées à la commande, dans un délai de quatorze (14) jours à compter de la réception l’ensemble des éléments permettant de mettre en œuvre le remboursement du Client.
Ce remboursement pourra être effectué par le même moyen de paiement que celui employé pour le Client. A ce titre, le Client ayant réglé sa commande sous forme d'avoirs / bons cadeau pourront être remboursés par avoirs / bons cadeau selon la volonté de l’Exploitant.
En acceptant les présentes Conditions Générales, le Client reconnaît expressément avoir été informé des modalités de rétractation.
Toute demande d’annulation et de remboursement pour raisons quelconque ou sanitaire liée à la pandémie COVID, devra intervenir au plus tard 48h avant le début de la réservation. L’Exploitant se réserve le droit de ne pas répondre à la demande dans le cas contraire.
Article 10 - CUSTOMER SERVICE
The customer may contact the Operator :

Article 11 - INTELLECTUAL PROPERTY AND LICENSE OF USE
The Operator is the sole owner of all elements present on the Site and associated applications, notably and without limitation, all texts, files, images animated or not, photographs, videos, logos, drawings, models, software, trademarks, visual identity, database, Site structure and all other elements of intellectual property and other data or information (hereinafter, the "Elements") which are protected by French and international laws and regulations relating notably to intellectual property.
Trademarks, logos, signs and all site content (text, images, sound, etc.) are protected by the French Intellectual Property Code, and more specifically by copyright.
Consequently, none of the elements of the Site or mobile application may be modified, reproduced, copied, duplicated, sold, resold, transmitted, published, communicated, distributed, broadcast, represented, stored, used, rented or exploited in any other way, whether free of charge or against payment, by a Customer, a Supplier or by a third party, whatever the means and/or media used, whether known or unknown to date, without the express prior written authorization of the Operator on a case-by-case basis, and the Customer and Supplier shall be solely liable for any unauthorized use and/or exploitation.
The Customer and the Supplier must seek the prior authorization of the Operator for any reproduction, publication or copying of the various contents. They undertake to use the contents of the site in a strictly private context; any use for commercial or advertising purposes is strictly forbidden.
Furthermore, it is hereby specified that the Operator is not the owner of the content placed online by partner Suppliers, for which the latter remain fully responsible and guarantee the Operator against any recourse in this respect. Suppliers grant the Operator a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use the intellectual property content they publish on the Site, and the supplier application for the duration of the protection of such content.
The Operator reserves the right to take legal action against any person who fails to comply with the prohibitions contained in this article.
Any total or partial representation of this site by any means whatsoever without the express authorization of the website operator constitutes an infringement punishable by article L 335-2 et seq. of the French Intellectual Property Code.
In accordance with article L122-5 of the French Intellectual Property Code, the Customer or Supplier who reproduces, copies or publishes protected content must cite the author and source.
ARTICLE 12 - LIABILITY AND GUARANTEE
The Operator declares that it has taken out civil liability insurance covering its professional and contractual liability.
The Operator may not be held liable for non-performance of the contract by the Customer or the partner Suppliers due to an event qualified as force majeure by the competent courts, or due to the unforeseeable and insurmountable act of any third party to the present contract.
The Operator may not be held liable for information imported, stored and/or published on the Site or mobile applications by Customers or by Suppliers. The Operator may not be held liable for any information published by a Customer or Supplier on the Site or mobile applications and for any direct or indirect damage that such use may cause to a third party, the Supplier remaining solely liable in this respect.
The Customer and the Supplier acknowledge that the characteristics and constraints of the Internet make it impossible to guarantee the security, availability and integrity of data transmissions over the Internet. Accordingly, the Operator does not guarantee that the Site and mobile applications and its services will operate without interruption or error. In particular, their operation may be temporarily interrupted for maintenance, updates or technical improvements, or to change their content and/or presentation.
The Operator may not be held liable for any use of the Site and mobile applications and its services by Customers and Suppliers in breach of these General Terms and Conditions, nor for any direct or indirect damage that such use may cause to a Customer, Supplier or third party. In particular, the Operator may not be held liable for any false declarations made by a Customer or Supplier, or for his or her conduct vis-à-vis third parties. In the event that the Operator is held liable for such conduct on the part of one of its Customers or Suppliers, the latter undertake to indemnify the Operator against any judgement pronounced against it, and to reimburse the Operator for all costs, in particular legal fees, incurred in its defense.
The Supplier is solely responsible for all content it places online on the Site and mobile application, and expressly declares that it holds all rights thereto. In this respect, the Supplier guarantees the Operator that it will not place any content online that violates third-party rights, in particular intellectual property rights, or that constitutes an attack on persons (in particular defamation, insults, insults, etc.), respect for privacy or any other rights.), privacy, public order and public decency (in particular, apology for crimes against humanity, incitement to racial hatred, child pornography, etc.).
In the event of infringement of current laws, public decency or the present General Terms and Conditions, the Operator may automatically exclude Suppliers guilty of such infringements and remove information and links to such litigious content.
The Operator qualifies as a host with regard to content placed online by third parties. The Operator has no general obligation to monitor content transmitted or stored via the Site and mobile applications. In the event that the Operator is held liable for content posted online by the Supplier, the Supplier undertakes to indemnify the Operator against any judgment against it, and to reimburse the Operator for all costs incurred in its defense, in particular legal fees.
Article 13 - PERSONAL DATA
Each Customer and Supplier is solely responsible for preserving the confidentiality of his login and password, and telephone number, and is solely responsible for all access to his Customer/Supplier Account, whether authorized or not.
The Operator may not be held liable for any action or damage carried out via the Customer's or Supplier's personal space by a third party who may have had access to the Customer's or Supplier's login and password or cell phone as a result of a fault or negligence attributable to the Customer/Supplier.
The Customer and Supplier undertake to inform the Operator immediately if the Customer/Supplier becomes aware of or suspects any unauthorized use of or access to their personal space.
For further information on the use of personal data by the Operator, please read the Privacy Policy Charter (the " Charter") carefully. You can consult this Charter on the Site at any time.
The Site and the application ensure that the Customer and the Supplier collect and process personal information in compliance with the French Data Protection Act no. 78-17 of January 6, 1978.
Under the French Data Protection Act of January 6, 1978, the Customer and Supplier have the right to access, rectify, delete and oppose their personal data.

Article 14 - HYPERTEXT LINKS
Hypertext links available on the Site and mobile applications may lead to third-party sites not published by the Operator. They are provided solely for the convenience of the Customer and the Supplier, in order to facilitate the use of the resources available on the Internet. If the Customer/Supplier uses these links, he/she will leave the Site and agree to use the third-party sites at his/her own risk or, as the case may be, in accordance with the conditions governing them.
The Customer and Supplier acknowledge that the Operator neither controls nor contributes in any way to the elaboration of the conditions of use and/or the content applying to or appearing on these third-party sites.
Consequently, the Operator cannot be held responsible in any way whatsoever as a result of these hypertext links.
Furthermore, the Customer and Supplier acknowledge that the Operator does not endorse, guarantee or take over all or part of the conditions of use and/or content of these third-party sites.
The Site and mobile application may also contain promotional hypertext links and/or advertising banners referring to third-party sites not published by the Operator.
The Operator invites Customers and Suppliers to inform the Operator of any hypertext link present on the Site or mobile application that would allow access to a third-party site proposing content contrary to the law and/or morality.
Customers and Suppliers may not use and/or insert hypertext links pointing to the Site without the prior written consent of the Operator on a case-by-case basis.
Article 15: Cookies
The Customer and the Supplier are informed that during their visits to the site and the mobile application, a cookie may be automatically installed on their browser software.
Cookies are small files stored temporarily on the hard disk of the user's computer by your browser and which are necessary for the use of the SeaLocker site. Cookies do not contain any personal information and cannot be used to identify anyone. They contain a unique identifier, randomly generated and therefore anonymous.
Some cookies expire at the end of the Customer's / Supplier's visit, others remain. The information contained in cookies is used to improve the SeaLocker site and mobile applications. By browsing the site and mobile applications, the Customer and Supplier accept them.
The Customer and the Supplier may deactivate these cookies by using the settings in their browser software.
Article 16 - REFERENCES
The Customer and Supplier authorize the Operator to mention their name and logo as a reference in its communication media (brochure, website, commercial proposal, press relations, press release, press kit, internal communication, etc.).
Article 17 - SPECIAL CONDITIONS, SURFING ON REUNION
SeaLocker has been working since June 2021 in partnership with certain Suppliers, in order to offer "surfboard" products on the island of Reunion.This article concerns Customers who use the SeaLocker service on this territory.
Customers practicing on Reunion Island are reminded that the practice of nautical activities using the motive force of waves (surfing, bodyboarding, bodysurfing, longboarding, paddle boarding) is authorized by prefectoral decree n°216 of February 06 -article 2- only in lagoons and ZONEXs (Zones d'Expérimentation Opérationnelles), under the conditions provided for by a municipal decree.
Thus, the Customer undertakes to surf only in the location indicated below: "spot de la Pointe des Trois Bassins", and in the deployment slots of the Vigies Requins Renforcé only (indicated daily on the official Instagram account of the VRR: https://www.instagram.com/vigiesrequin/?hl=en)
Practice outside the ZONEXs is prohibited by the prefecture, and any offender is liable to prosecution, criminal penalties, and the risk of interaction with a targeted shark (tiger or bulldog).
The Customer acknowledges having been sufficiently informed and having read and accepted the moral contract appended to the rental contract which will be sent to him upon reservation, for the practice of surfing in Reunion Island.
The Supplier's responsibility as well as that of Sealocker cannot be engaged in the event that the Customer does not respect the directives communicated by the Prefecture of Reunion Island.
Article 18 - GENERAL PROVISIONS
INTEGRALITY OF THE AGREEMENT BETWEEN THE PARTIES
These General Terms and Conditions constitute a contract governing relations between the Customer, the Supplier and the Operator. They constitute the entirety of the rights and obligations of the Customer, the Supplier and the Operator relating to their subject matter. Should one or more stipulations of these General Terms and Conditions be declared null and void in application of a law, regulation or following a final decision by a competent court, the other stipulations shall retain their full force and scope. Furthermore, the fact that one of the parties to these General Terms and Conditions does not invoke a breach by the other party of any of the provisions of these General Terms and Conditions shall not be construed as a waiver on its part to invoke such a breach in the future.
MODIFICATIONS TO TERMS AND CONDITIONS
The Operator reserves the right to modify at any time and without notice the content of the Site and mobile applications or the services available therein, and/or to cease temporarily or permanently to operate all or part of the Site and mobile applications.
In addition, the Operator reserves the right to modify at any time and without notice the location of the Site and mobile applications on the Internet, as well as these General Terms and Conditions. The Customer and the Supplier must therefore refer to these General Terms and Conditions before using the Site and the mobile applications.
The Customer and the Supplier acknowledge that the Operator may not be held liable in any way whatsoever to them or to any third party as a result of such modifications, suspensions or cessations.
The Operator advises the Customer and the Supplier to save and/or print these General Terms and Conditions for safe and durable storage, and to be able to invoke them at any time during the performance of the contract if necessary.
CLAIMS - MEDIATION

Inthe event that the request for a complaint to the customer service department is unsuccessful, or in the absence of a response from this department within ten (10) days, the Customer and the Supplier may submit the dispute relating to the purchase order or these GTC opposing them to the Operator to the following mediator: nicolas.farolfi@sealocker.fr
Themediator will attempt, independently and impartially, to bring the parties together with a view to reaching an amicable solution. The parties remain free to accept or refuse recourse to mediation as well as, in the event of recourse to mediation, to accept or refuse the solution proposed by the mediator.
APPLICABLE LAW
These General Terms and Conditions are governed, interpreted and applied in accordance with French law.
ACCEPTANCE OF GENERAL TERMS AND CONDITIONS BY THE CUSTOMER AND THE SUPPLIER
TheCustomer and the Supplier acknowledge that they have carefully read these General Terms and Conditions.
By registering on the Site, and the mobile applications, the Customer and the Supplier confirm that they have read the General Terms and Conditions and accept them, making them contractually bound by the terms of these General Terms and Conditions.
The General Terms and Conditions applicable to the Customer and the Supplier are those available on the date of the order, a copy of which dated to that date may be given to the Customer or the Supplier on request. It is therefore specified that any modification of the General Terms and Conditions made by the Operator will not apply to any order placed previously, unless expressly agreed by the Customer or the Supplier at the origin of a given order.
